Welcome to Treasured LLC. These Terms of Service ("Terms") govern your access to and use of the Treasured LLC website, including purchases of gemstones, jewelry, custom jewelry, and other products offered through the website.
Throughout these Terms, "Treasured," "we," "us," and "our" refer to Treasured LLC, a Louisiana limited liability company. "You" and "your" refer to any visitor, customer, or other user of our website.
By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms. If you do not agree to these Terms, please do not use the website or place an order.
1. OUR PRODUCTS
Treasured LLC specializes in loose gemstones, finished jewelry, and custom or made-to-order jewelry.
Many of our gemstones are natural materials and may be individually sourced. Each gemstone may therefore be unique in appearance and characteristics.
Product-specific information provided on an individual product page, including information regarding gemstone type, weight, dimensions, treatment, origin, laboratory reports, precious metal content, and other characteristics, forms part of the description of that product.
Natural gemstones may contain inclusions, color zoning, surface features, internal characteristics, and other naturally occurring variations. These characteristics are not necessarily defects and may contribute to the individual appearance and identity of a gemstone.
2. GEMSTONE TREATMENTS AND DISCLOSURES
Where applicable, Treasured LLC will disclose gemstone treatments or enhancements in accordance with applicable law and industry requirements.
Treatment information known to us and required to be disclosed will be stated in the applicable product description or accompanying documentation.
Customers are responsible for reviewing the complete product description and any accompanying laboratory report before completing a purchase.
Unless expressly stated otherwise in an individual product listing, nothing in these Terms should be interpreted as representing that a particular gemstone is untreated, heated, unheated, enhanced, or subject to any particular treatment.
3. GEMSTONE ORIGIN
When a geographic origin is stated for a gemstone, the statement will be based on information reasonably available to us, which may include supplier information, provenance, or an independent gemological laboratory report.
For certain gemstones, geographic origin cannot be determined with absolute certainty. Origin determinations made by independent laboratories are professional opinions based on available gemological evidence and may differ between laboratories.
Where an origin is specifically stated as having been determined by a laboratory, the relevant laboratory report should be considered the controlling source for that laboratory's opinion.
4. LABORATORY REPORTS AND CERTIFICATES
Certain gemstones may be offered with reports from independent gemological laboratories.
These laboratories are independent third parties and are not controlled by Treasured LLC. A laboratory report reflects the findings and opinions of the issuing laboratory at the time of examination.
Treasured LLC does not alter or independently guarantee the conclusions of an independent laboratory.
Different laboratories or gemologists may occasionally reach different conclusions regarding matters such as geographic origin, treatment, color classification, or other gemological characteristics.
Where a gemstone is sold with a laboratory report, the report provided with the stone is part of the product documentation and should be reviewed before purchase.
5. PHOTOGRAPHY AND COLOR
We make reasonable efforts to present our gemstones and jewelry as accurately as possible.
However, gemstones may appear different depending on lighting conditions, viewing angle, camera equipment, photography, background, magnification, and other factors.
Colors displayed on your device may also vary depending on your screen, display settings, and device.
Accordingly, we cannot guarantee that the color displayed on your screen will precisely match the appearance of the gemstone when viewed in person.
Product images may be enlarged to show detail. Customers should refer to the stated dimensions and carat weight to understand the actual size of a gemstone.
6. WEIGHTS AND MEASUREMENTS
Gemstone weights and dimensions are provided in the applicable product listing.
Measurements may be rounded within reasonable industry tolerances.
Where exact weight or dimensions are material to your purchase decision, you should review the stated specifications and any accompanying laboratory report before placing your order.
7. JEWELRY AND PRECIOUS METALS
Where jewelry is offered for sale, the applicable product page will identify the represented precious metal or material, such as 14-karat gold, 18-karat gold, platinum, sterling silver, or another material.
Due to manufacturing and finishing processes, finished jewelry weights and dimensions may vary slightly from stated specifications unless expressly represented as exact.
8. PRODUCT AVAILABILITY
Many gemstones sold by Treasured LLC are individual or one-of-a-kind items.
Placing an item in your shopping cart does not reserve that item.
A product remains subject to availability until your order has been accepted by us.
In the unlikely event that the same unique item is purchased by more than one customer, we may cancel the later or otherwise unavailable order and issue a full refund.
9. PRICING
All prices are displayed in the currency identified on the website.
Prices may change at any time before an order is placed.
We make reasonable efforts to ensure that product descriptions and prices are accurate. However, typographical, technical, or pricing errors may occasionally occur.
If we discover a material pricing or listing error after an order has been submitted, we may contact you to offer the opportunity to proceed at the correct price or cancel the order and receive a full refund.
10. ORDERS
Submission of an order does not necessarily constitute our final acceptance of that order.
We reserve the right, to the extent permitted by law, to decline or cancel an order for legitimate reasons, including suspected fraud, payment issues, inventory errors, obvious pricing errors, shipping restrictions, inability to verify customer information, or legal restrictions relating to the destination country.
If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled order.
11. PAYMENT
Payment must be made using one of the payment methods available at checkout.
You represent that you are authorized to use the payment method submitted with your order and that all billing information you provide is accurate.
Payment processing may be performed by third-party payment processors and may be subject to their separate terms and privacy policies.
12. SHIPPING
Treasured LLC ships to destinations worldwide where shipping and importation are legally and commercially feasible.
Available shipping methods, estimated delivery periods, and applicable shipping charges will be displayed during checkout or otherwise communicated before purchase.
Delivery estimates are estimates only unless expressly guaranteed.
Treasured LLC is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, customs processing, weather, transportation disruptions, international border processing, strikes, or incorrect delivery information supplied by the customer.
For high-value shipments, Treasured LLC may require signature confirmation and may use insured shipping.
Customers are responsible for providing a complete and accurate shipping address.
13. INTERNATIONAL ORDERS, CUSTOMS, DUTIES, AND TAXES
Treasured LLC ships internationally, subject to applicable laws, carrier restrictions, and import regulations.
The customer is responsible for determining whether the purchased product may legally be imported into the destination country.
Unless expressly stated otherwise at checkout, customs duties, import taxes, VAT, brokerage fees, customs handling charges, and similar charges imposed by the destination country are the responsibility of the customer.
These charges are not included in the purchase price unless expressly stated otherwise.
Treasured LLC is not responsible for customs delays, inspections, seizures, import restrictions, or charges imposed by foreign customs authorities.
We will not intentionally falsify customs declarations, invoices, product descriptions, or product values.
If an international shipment is refused by the customer or returned because customs charges, duties, taxes, or import requirements were not fulfilled, any refund will be handled in accordance with applicable law and our Return and Refund Policy. Shipping charges, customs fees, duties, taxes, or other non-recoverable expenses may be deducted from a refund where legally permitted.
14. RETURNS
Unless otherwise stated in the applicable product listing or these Terms, eligible products may be returned within 14 days after confirmed delivery.
To start a return, contact Treasured LLC within the 14-day return period and follow the return instructions provided by us.
The return period begins on the date the applicable shipping carrier records the order as delivered.
Products returned outside the 14-day period may not be accepted unless required by applicable law. Refunds are issued after the returned stone has been received and inspected.
15. RETURN CONDITION
Returned products must be returned in the same condition in which they were received.
Loose gemstones must not have been:
damaged;
chipped;
scratched;
altered;
recut;
polished;
drilled;
engraved;
set into jewelry;
removed from a sealed or protected condition where such protection was provided; or
otherwise modified after delivery.
Jewelry must not have been altered, damaged, resized, engraved, repaired, modified, or materially worn.
All original laboratory reports, certificates, packaging, documentation, tags, accessories, and other materials supplied with the item must be returned.
Treasured LLC reserves the right, where permitted by law, to reject a return if the returned product is not the same product originally shipped, has been altered, damaged, substituted, or returned without required accompanying documentation.
Nothing in this section limits rights that cannot legally be waived.
16. RETURN SHIPPING
Customers are responsible for all return shipping costs unless the return is required because we shipped the incorrect item, the product arrived damaged, or applicable law requires otherwise.
Customers are responsible for securely packaging returned items.
Because gemstones and jewelry may have substantial value, we strongly recommend using a tracked and appropriately insured shipping service.
Treasured LLC is not responsible for a return shipment that is lost, stolen, misdirected, or damaged before it is received by us, except where applicable law provides otherwise.
A return is not considered received until it has been physically delivered to and accepted by Treasured LLC or our designated return facility.
17. REFUNDS
Once an eligible return has been received and inspected, we will process the applicable refund in accordance with our Return and Refund Policy.
Approved refunds will generally be issued to the original payment method.
Original shipping charges, expedited shipping charges, international shipping charges, customs duties, VAT, brokerage fees, taxes, and return shipping costs are generally non-refundable unless required by law or unless the return resulted from an error by Treasured LLC.
Processing times after a refund is issued may vary depending on your bank, credit card company, or payment provider.
18. CUSTOM AND MADE-TO-ORDER JEWELRY
Treasured LLC may offer customers the opportunity to select a gemstone and commission custom or made-to-order jewelry, including rings, necklaces, earrings, bracelets, and other jewelry.
Custom jewelry may involve individually selected gemstones, precious metals, ring sizes, design specifications, settings, engravings, dimensions, or other personalized features.
Before production begins, the customer is responsible for reviewing and approving all material specifications provided for the custom order.
Once a customer approves a custom order and production begins, the order may not be cancelled, changed, returned, or refunded except as required by applicable law or where Treasured LLC agrees otherwise in writing.
Custom, personalized, engraved, resized, specially manufactured, or made-to-order jewelry is generally excluded from the standard 14-day return policy unless it arrives damaged, materially defective, materially different from the approved specifications, or applicable law provides otherwise.
19. CUSTOM JEWELRY VARIATIONS
Because custom jewelry is individually manufactured and often handcrafted, minor variations may occur between drawings, renderings, photographs, prototypes, and the finished piece.
Minor variations that are consistent with normal jewelry manufacturing practices will not necessarily constitute a defect.
Gemstones also vary naturally in shape, proportions, color distribution, inclusions, and other characteristics, and the appearance of a gemstone may change after it is mounted.
20. RING SIZING
Customers ordering rings are responsible for providing the correct ring size.
If a ring is manufactured according to the size provided or approved by the customer, an incorrect customer-provided size does not constitute a manufacturing defect.
Where possible, Treasured LLC may offer resizing for an additional fee.
Certain ring designs, gemstones, eternity bands, settings, and materials may have limited resizing possibilities or may not be resizable.
21. INSPECTION UPON DELIVERY
Customers should inspect their order promptly after delivery.
If an item arrives damaged, appears materially different from what was ordered, or an item is missing from the shipment, please contact us promptly at langley@treasured.global.
Please retain the product, packaging, shipping materials, delivery packaging, and all documentation while the matter is being reviewed.
22. CARE OF GEMSTONES AND JEWELRY
Gemstones differ significantly in hardness, toughness, stability, and sensitivity to heat, chemicals, ultrasonic cleaning, steam cleaning, impact, and environmental conditions.
Customers should follow any specific care instructions supplied with their gemstone or jewelry.
Certain gemstones and treatments require specialized care.
If you are uncertain how to clean or care for a gemstone or jewelry item, you should contact Treasured LLC, a qualified jeweler, or a qualified gemologist before using chemical, ultrasonic, steam, mechanical, or other intensive cleaning methods.
23. RESALE AND INVESTMENT VALUE
Gemstones and jewelry should not be purchased based on an assumption that they will increase in value.
Unless expressly stated otherwise in writing, Treasured LLC does not provide financial, investment, or resale advice and does not guarantee future market value, resale price, appreciation, liquidity, or investment performance of any gemstone or jewelry item.
24. WEBSITE INFORMATION
We make reasonable efforts to keep information on our website accurate and current.
However, occasional errors or omissions may occur.
We may correct errors, update information, or modify website content where reasonably necessary, subject to applicable law.
25. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of the Treasured LLC website, including photographs, gemstone photographs, videos, graphics, logos, branding, text, product descriptions, jewelry designs, website design, and other original content, is owned by or licensed to Treasured LLC and is protected by applicable intellectual property laws.
You may not reproduce, distribute, commercially exploit, modify, publish, or use our content without prior written permission except as permitted by law.
26. PROHIBITED USE
You may not use our website:
for unlawful or fraudulent purposes;
to attempt unauthorized access to the website or related systems;
to introduce malicious software or code;
to interfere with the operation or security of the website;
to impersonate another person;
to provide intentionally false payment or shipping information;
to engage in fraudulent chargebacks or payment disputes;
to unlawfully copy or commercially exploit our website content; or
to infringe the intellectual property or other legal rights of Treasured LLC or another person.
27. THIRD-PARTY SERVICES
Our website may use or link to services operated by third parties, including payment processors, shipping carriers, social-media platforms, laboratories, or other service providers.
Treasured LLC does not control third-party websites or services and is not responsible for their independent content, policies, availability, or practices.
28. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS EXCEPT FOR WARRANTIES OR REPRESENTATIONS EXPRESSLY PROVIDED BY TREASURED LLC.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, STATUTORY RIGHTS, OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
29. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TREASURED LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR PURCHASE OF PRODUCTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, TREASURED LLC'S TOTAL LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO TREASURED LLC FOR THE PRODUCT GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY WHERE LIABILITY CANNOT LEGALLY BE LIMITED OR EXCLUDED.
30. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Treasured LLC and its members, managers, employees, and agents from claims, liabilities, losses, or expenses arising from your unlawful misuse of the website, violation of these Terms, or infringement of another person's rights.
31. GOVERNING LAW
These Terms and transactions with Treasured LLC are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Because Treasured LLC sells internationally, customers located outside Louisiana or outside the United States may have mandatory consumer rights under the laws applicable to them.
Nothing in these Terms is intended to waive rights that cannot legally be waived.
32. DISPUTES
We encourage customers to contact us first if a dispute arises so that we may attempt to resolve the matter directly.
Unless applicable law provides otherwise, disputes arising from these Terms or a transaction with Treasured LLC will be subject to the jurisdiction of the appropriate state or federal courts located in the State of Louisiana.
Nothing in this section prevents either party from exercising rights or remedies that cannot legally be waived.
33. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
34. NO WAIVER
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
35. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The updated version will be posted on this page with a revised "Last Updated" date.
Changes will apply prospectively unless applicable law permits otherwise.
